1987年,美国最高法院裁定,美国诉Stanley案(英语:United States v. Stanley)中,在不知情的情况下,因为医学实验服用LSD的军人不能要求美军赔偿损失。
不同意美国诉Stanley案中的判决结果,桑德拉·戴·奥康纳法官说:
>>No judicially crafted rule should insulate from liability the involuntary and unknowing human experimentation alleged to have occurred in this case. Indeed, as Justice Brennan observes, the United States played an instrumental role in the criminal prosecution of Nazi officials who experimented with human subjects during the World War II , and the standards that the Nuremberg trials developed to judge the behavior of the defendants stated that the 'voluntary consent of the human subject is absolutely essential ... to satisfy moral, ethical, and legal concepts.' If this principle is violated, the very least that society can do is to see that the victims are compensated, as best they can be, by the perpetrators.
1994年1月15日,比尔·柯林顿总统成立了人体放射性实验谘询委员会(ACHRE)。这个委员会成立调查和报告在联邦政府资助的研究中,使用人类作为电离辐射受试者的影响。该委员会试图确定实验的原因,以及为什么没有被正确监管,并提出了几条帮助防止未来发生类似事件的建议。
截至2007年,没有任何一名美国政府研究人员由于进行人实验而遭到起诉。
